Copyright & Infringement Reporting

Philosophie.ch is a public portal that hosts philosophical content, including media uploaded by third-party users. While we encourage the respectful and legal use of all materials, we cannot guarantee that every uploaded asset complies with copyright law. We act in good faith and are committed to addressing valid copyright infringement claims swiftly and transparently. If a claim meets the necessary requirements, we will take appropriate action without undue delay.

We ask all contributors to consult our guide "How to Use Images and Other Media" before uploading any content. This guide outlines how to use media lawfully and avoid copyright issues.

Please refer to the information below for how to submit a valid infringement notice.

1. Ownership

The copyrights and all other rights to the content, images, photos or other files on the website belong exclusively to Philosophie.ch or to the specifically named rights holders, in particular to the named authors. The written consent of the copyright holders must be obtained in advance for the reproduction of any elements.

2. Designated Agent

Please direct all copyright infringement notices to:

3. Notice Requirements

To be valid, notices must include:  

  1. The claimant's name, address, and email address
  2. An explanation of why the claimant is particularly affected
  3. Identification of the material subject of the complaint (URL)  
  4. A precise description of the allegedly illegal content
  5. A reason as to why the content is illegal
  6. A statement of good‑faith belief of unauthorized use  
  7. A declaration that the sender has a good faith belief in the accuracy of his/her report

Please refer to the Swiss Internet Industry's Association "Hosting Code of Conduct" (HCC), article 4.3 for more details.

 

Preferred Notice Method

We strongly encourage rights‑holders to submit infringement notices via the "Report this asset" button displayed on each media asset of the portal, as this provides the sender a pre-filled e-mail with all the necessary fields and thus ensures the fastest processing.

Alternatively, notices may be emailed to copyright@philosophie.ch, but they must contain all the necessary information as stated in section 2 above.

In any case, if your notice is incomplete, we will request the missing information within two business days.

Images, audio, and videos all around the portal show, on hover, the "Report this asset" button.

Acknowledgment

Once a complete notice is received, we will confirm receipt to you and notify the uploader within two business days.  


Supporting Documentation

We may request, within that same two‑day supplementation window, supporting documents (e.g. registration certificates, license agreements, screenshots) to verify your entitlement to submit a notice.  


Incomplete or Unanswered Notices

If you do not supply all required information (as detailed above), we will consider the notice invalid and will not take down or block the content until you complete your case.

4. Takedown & Stay‑Down

Upon receipt of a valid notice, we will remove or disable access "without undue delay" and implement measures to prevent re‑uploads of the same content.

We record all infringement notices and our corresponding actions—timestamps, uploader account, URL(s), and all communications—in secure logs retained for a minimum of one year. These logs ensure rapid handling, compliance with Swiss law, and enable automated prevention of repeat infringements.

5. Repeat Infringers

Accounts subject to three valid takedown notices within 12 months may be suspended or terminated.

6. Governing Self‑Regulation

This process follows the Swiss Internet Industry Association's "Hosting Code of Conduct" (HCC).

7. User Warranties

By uploading content, you warrant you have all necessary rights and agree to indemnify Philosophie.ch against related claims.
